Mortgage Loans

Any person who engages in mortgage loan activity (Mortgage Loan), as defined by the Arkansas Fair Mortgage Lending Act, in Arkansas or with an Arkansas consumer must be licensed by the Department.

The Department receives all Mortgage Loan applications via the Nationwide Multistate Licensing System (NMLS). View the Arkansas State Licensing Requirements for the Mortgage Broker Description, Mortgage Banker Description, Mortgage Servicer Description, the Mortgage Loan Officer Description, as well as Branch License Descriptions for each license type and the Combination of Mortgage Broker, Mortgage Banker and/or Mortgage Servicer Licenses Description.

Mortgage Broker

A Mortgage Broker license is required for any person, who for compensation or other gain, or in the expectation of compensation or gain, and regardless of whether the acts are done directly or indirectly, through contact by telephone, electronic means, by mail, or in person with the borrowers or potential borrowers, accepts or offers to accept an application for a mortgage loan; solicits or offers to solicit an application for a mortgage loan, negotiates or offers to negotiate the terms or conditions of a mortgage loan; or issues or offers to issue mortgage loan commitments or interest rate guarantee agreements to borrowers.

Mortgage Banker

A Mortgage Banker license is required for any person who engages in the business of making mortgage loans for compensation or other gain.

Mortgage Servicer

A Mortgage Servicer license is required of any person that receives from or on behalf of a borrower funds or credits in payment for a mortgage loan, or the taxes or insurance associated with a mortgage loan.

Mortgage Loan Officer

A Mortgage Loan Officer license is required for any individual, other than exempt person, who in exchange for compensation as an employee of or who otherwise receives compensation or remuneration from a Mortgage Broker or a Mortgage Banker licensed in Arkansas; solicits or offers to solicit an application for mortgage loan; accepts or offers to accept an application for mortgage loan; negotiates or offers to negotiate the terms or conditions of a mortgage loan; or issues or offers to issue mortgage loan commitment or interest rate guarantee agreement.

License Requirements and Fees:

Combination License

Combination License: A person wishing to apply for two (2) or more of the following licenses: Mortgage Broker, Mortgage Banker, and/or Mortgage Servicers should apply for the Combination of Mortgage Broker, Mortgage Banker and/or Mortgage Servicer Licenses. The license requirements of each separate license types of Mortgage Broker, Mortgage Banker, and/or Mortgage Servicer must be met.

License Requirements and Fees:

A separate Branch License is required for each location of any person who engages in mortgage loan activities as a broker, banker, or servicer. Please see the Arkansas State Licensing Requirements for more information.

Continuing Education

Pre-licensing education is required for MLO licensure and continuing education is required for a MLO renewal application.
